The Frank R. Lautenberg Chemical Safety for the 21st Century Act, signed into law on June 22, 2016, amended the Toxic Substances Control Act (TSCA), the Nation’s primary chemicals management law. The new law, which received bipartisan support in both the U.S. House of Representatives and the Senate, included changes to TSCA. TSCA provides broad authority to EPA to assure protection of human health and the environment from unreasonable risks associated with chemical substances. TSCA also regulates the export of certain chemical substances and mixtures in any amount outside the customs borders of the U.S, and requires that foreign governments be notified by EPA of certain chemical substances and mixtures exported from the U.S into their country. Any person who intends to ship (export) a TSCA regulated chemical substance outside the U.S must make a determination, and if required, provide written notification to EPA within a very specific timeframe.
