Course Outline

This course covers the easements that Land Surveyors most often encounter, along with those that are not as easy to spot. There is a discussion of how each of these easements can be created or extinguished.

This course includes a multiple-choice quiz at the end, which is designed to enhance the understanding of the course materials.

Learning Objective

At the conclusion of this course, the student will:

  • Have a greater understanding of what an easement is;
  • Understand the steps involved in creating an easement;
  • Be familiar with the evidence of an easement;
  • Understand what an unrecorded easement is and how to spot it;
  • Learn how to describe an easement properly;
  • Learn the procedures that create easements;

  • Be familiar with the Statute of Frauds;
  • Understand why as easement can fail;
  • Be familiar with dedication; and
  • Understand the concept of Eminent Domain.

Attendee of this course will understand the utmost importance of easements and how they affect the surveys we perform. The attendee will be more confident in their ability to locate easements and explain them to his client.

Course Introduction

The Land Surveyor should be keenly aware of the possibility of easements prior to entering the field to perform a survey and while in the field he should be on guard for evidence that these easements exist, particularly the unwritten easements. This course is designed to give the practicing Land Surveyor an overview of the typical easements that are encountered while surveying. Easements are typically taken for granted while performing land surveys and the title information provided to the surveyor is usually lacking, but if the Surveyor in on guard for the possibility of these easements, their existence and location can be determined.
